IMPORTANT: In order to reserve a space for your child, this Agreement, a tuition deposit and the Activity and Supply Fee must be received by February 9, 2022.
Terms and Conditions
1. I/We acknowledge receipt, review, completion in full, and submission of all application materials upon which we understand Star Academy is relying to its detriment. I/We also acknowledge receipt, review and understanding of, and agreement with Star Academy’s School Parent Guide and all other policies and procedures.
2. Both to ensure student success, and to confirm our ability to comprehensively meet student needs, the first one (1) month of a student's enrolment will be specified to be a probationary period. Star Academy will ensure that each probationary student has reasonable opportunities to demonstrate their abilities, and to actualize their potential. These opportunities will include all of a testing of the student's skills, the student's ability to work in harmony with others, and an assessment of the student's future likelihood to succeed while enrolled in Star Academy. Probationary admission will be reviewed after the completion of one (1) month, and Star Academy will then confirm (or not) the successful completion of this probationary period, and the continued (or not) registration.
3. In consideration of the acceptance of the offer by Star Academy of such application, I/we jointly and severally agree to pay all school fees (including registration and tuition fees where applicable), and other charges incurred by the student or on the student’s behalf in accordance with the Fee Schedule.
I/We understand that our obligation to pay all fees for the full academic year is unconditional and that no portion of such fees paid or outstanding will be refunded or cancelled.
A charge of $20 will apply to any cheques returned due to non-sufficient funds. Interest at 1.5% per month or 18% per annum will be added to accounts that exceed 15 days overdue. Star Academy reserves the right to withdraw services at any time if accounts are not paid in accordance with the established due dates.
Star Academy’s policy dictates that no adjustment or refund of any kind of annual tuition fees can be made by the school for absences, withdrawal, or dismissal. This policy is necessary to ensure that Star Academy can manage its continuing fixed operating expenses and maintain its services throughout the year.
4. Star Academy is not responsible for the delay or failure to perform any of its obligations if that delay or failure is the result of an unforeseen event beyond the reasonable control of Star Academy (hereinafter referred to as a force majeure event). For the purposes of this paragraph, a force majeure event is agreed to be any act, occurrence, condition, or event beyond the control of Star Academy that materially affects the performance of Star Academy’s obligations under this agreement that could not reasonably have been foreseen or provided against. Such events include, but are not limited to: acts of God; acts of governmental authority; acts of terrorism; brownouts; diseases; epidemics; fires; insurrections; military, national, or provincial declarations of emergency; natural disasters (including severe inclement weather); pandemics; power outages and interruptions; quarantines; riots; strikes; wars; and work stoppages and slowdowns. In the event of a force majeure event, all parents do hereby for themselves, their heirs, executors, administrators, successors, insurers and assigns release and forever discharge Star Academy, its administrators, successors, assigns, insurers, officials, officers, employees, servants and agents from any and all actions, causes of action, claims and demands for, upon or by reason of any damage, loss or injury, to person and property, including economic (tuition and other) loss, which may be sustained in consequence of the force majeure event. All parents agree not to make any claim or to take any proceedings against any other person or corporation who might claim contribution or indemnity from Star Academy.
5. Star Academy places a priority on keeping our students healthy and safe. To ensure the protection of children and the public, the Ontario Ministry of Health and Long Term Care administers a universal immunization program as part of the Immunization of School Pupils Act. Our local Public Health Unit is legally required to collect and to maintain a complete student immunization history for all diseases identified in The Ontario Immunization Schedule. A successful immunization program requires the cooperation of all of parents, of school staff, and of our Public Health Unit.
Parents/guardians must supply Star Academy with one or more of the following:
i. a copy of the student’s immunization record card;
ii. a copy of any immunization documentation (with dates) from another province or country;
iii. a letter from a physician with date(s) of immunization(s); or for parents/guardians choosing not to immunize their child between the ages of 4 to 17, an Official Confirmation of Exemption letter from our local Public Health Unit.
Existing school immunization requirements will be strictly enforced, and will not be deferred because of the current Covid-19 pandemic. In addition, although the Influenza vaccination is not legally required for school attendance, this vaccination is most strongly encouraged for all students and staff.
Covid is much more infectious and deadly than Influenza. Vaccines are much more effective (95% Covid vs. 20-60% Influenza). Accordingly, proof of a Health Canada currently approved complete (which includes two doses plus booster(s) when available) Covid-19 vaccination is required for all staff and students (ages 5 and over). Students ages 5 to 11 should submit their proof of current COVID-19 vaccination with registration and will have until July 15th, 2022 to submit their complete proof of vaccination to the office.
There are likely to be very few medical exemptions to Covid vaccination. The largest group of individuals who receive a medical exemption will be those with severe allergic reactions or anaphylaxis to a previous dose of a Covid vaccine or to any of its components and who have been assessed by an allergist/immunologist to review methods for a possible alternate administration of a Covid vaccine.
There are existing protocols to administer Covid vaccines to individuals with other types of allergies. These other types of allergies do not on their own constitute the grounds for a medical exemption.
Another group of individuals who may receive a medical exemption are those who are delaying their second dose because of a diagnosed episode of myocarditis/pericarditis after receipt of an initial dose of an mRNA vaccine.
In some instances, the medical reason for the person not being vaccinated may be time-limited (e.g., timing around a procedure or other medical treatment). The exempting medical note from the physician/nurse practitioner must specify whether the reason is permanent or time-limited. If time-limited, the note must indicate how long that exemption is expected to last.
Should a vaccination exemption be documented in order to accommodate legitimate human rights on the ground of either disability or creed, as defined under Ontario’s Human Rights Code, then Star Academy reserves the rights to so accommodate that student by one, some, or all of (as determined by the Principal/Director):
insisting upon the wearing of additional personal protective equipment by that non-vaccinated student or staff, which may include one, some, or all of a face mask, eye goggles, a face shield, a full-body gown, and nitrile gloves;
ii: requiring additional physical and social distancing by the non-vaccinated student;
iii. excluding the non-vaccinated students from activities and physical areas (such as lunch areas, by way only as examples) with a higher risk of infection transmission;
substituting other educational activities and physical areas; and requiring Covid nasal swab testing and results as frequently as twice weekly. (The median incubation period of Covid is 3 to 6 days, depending on the variant, from exposure to symptom onset.)
6. I/We confirm that we have provided Star Academy with all education and psychological assessment documents that pertain to our son/daughter. I/We understand that in the event that the above condition has not been met, Star Academy may not be able to provide appropriate services and reserves the right to require that our son/daughter withdraw from Star Academy.
7. We confirm that in the event that the behaviour of our son/daughter seriously jeopardizes the ability of Star Academy to ensure the safety and security of its students, interferes with the learning environment, or conducts such behaviour which is injurious to the physical or mental well-being of others, Star Academy reserves the right to require that he/she withdraw from Star Academy.
8. I/We understand that our child (in grades 5 to 8) is required to have a laptop computer and headphones, as well as a regular calculator (for grades 6 to 8 only). Students in Kindergarten to Grade 4 require their own set of headphones for use with the school iPads.
9. I/We understand, for the safety and security of all students and staff, Star Academy and its agents reserve the right at any time or times, with or without notice, to conduct searches of his or her personal property, and I/we irrevocably consent to such searches.
10. I/We understand that there are always risks of student personal injury, death, and damage to personal property, because of the activity-based academic, outdoor adventure and experiential, physical activity and sports components of the school programme. I/We acknowledge, accept, and assume these risks, and unequivocally and expressly consent to the above student’s full participation in all of the above programme requirements.
11. During our child’s enrolment at Star Academy, I/we authorize and appoint the Principal/Director of Star Academy and his/her agents:
(a) to act as legal guardians of our child in my absence and when reasonable means to reach me have been taken (i.e. field trips or emergency situations);
(b) to make all necessary decisions on our child’s behalf in all of these regards;
(c) to publicize any and all photographs (electronic or print media) and videos of, or including, our child taken in the usual or ordinary course of Star Academy’s programming; and
(d) to deliver to the parent(s) and/or the guardian(s) of our child, all report cards.
12. This Registration Agreement and the documents referred to herein constitute the entire agreement between the contracting parties concerning the subject matter hereof. All prior agreements, discussions, representations, warranties and covenants are merged herein. There are no warranties, representations, covenants or agreements, expressed or implied, between the parties except those expressly set forth in this agreement. Any amendments or modifications of this agreement must be in writing and must be executed by the contracting parties.
